Rule of Law: The Holy Grail
What Is It and Why Is It So Difficult to Build?
Since the end of the Cold War, “rule of law” has become the holy grail through which policymakers assert that developing countries can achieve a number of public goods:
democracy, security and stability, respect for human rights, economic growth, orderly dispute resolution, and the ability to counter corruption.
However, the record of achievement of many international development programs that claim to strengthen the rule of law have fallen far short of these expectations.
Why is the cleavage between expectations and experience so pronounced? Are the definitions of the “rule of law” and “legal systems” fuzzy?
Is there something inherently elusive in the achievement of rule of law? Do we expect too much from rule of law programs?
And is regime change sometimes necessary to achieve the rule of law?
Jensen’s lecture will begin to answer these questions and to suggest some conceptual and practical ways to pursue the holy grail more effectively.
